Although Australian law and justice regulate other public land in Brisbane, on the lands where Brisbane City Council imposes restrictions to fundamental human rights, the inconsistent restrictions by Brisbane City Council bear resemblances to corruption and discrimination.

 

Although Brisbane City Council had officially issued a permit to utilise Council-controlled territory for issuance of tracts, the same Brisbane City Council threatened the Christian with a fine if the Christian handed out tracts on Council-controlled territory.

 

Brisbane City Council refused to specify and exemplify how two general conditions of a permit would have been breached, but Brisbane City Council did specify extra conditions which Brisbane City Council refused to acknowledge officially. Brisbane City Council imposed extra restrictions on the Christian that the Christian must hold the tract towards the chest beneath the face and wait silently to be approached by the public, and was not allowed to hand out any tract unless someone approached and verbally requested to be given a tract; saying “Can I have one of those flyers?” Brisbane City Council refused to officially confirm these orally given special restrictions, but instead, Brisbane City Council officially denied that these special oral restrictions had been given by Brisbane City Council.

I invited Brisbane City Council to meet me on Friday 4 April in the designated area of the permit so that Brisbane City Council could demonstrate the exact limitations of the permit. Brisbane City Council did not show to the invited meeting. On Monday 7 Aprill, the Brisbane City Council employees approached me and threatened me with a fine if I continue to hand out flyers in the permitted area. In no way did Brisbane City Council demonstrate how the flyer must be held.

 

Brisbane City Council – you are a corrupt and dishonest organisation. You do not serve the interests of a democratic Australia, but you serve in the self-interests of your corrupt and dishonest Brisbane Council governance.

The corrupted Brisbane City Council can be contrasted by for example Hong Kong District Councils, where Basic Law and the Bill of Rights appear to more effectively protect human rights than in Brisbane Council controlled territory. Hong Kong seems to enjoy District Councils that operate more democratically in relation to freedom of assembly and freedom of expression than the corrupted Brisbane City Council.

 

Because Brisbane City Council in your reply (which took you 30 days [!] to write) have refused to specify in which way the two conditions of the permit would have been breached, you only further demonstrate that corrupt and dishonest nature of Brisbane City Council.

 

Australia deserves better than your pathetic dishonesty and corruption.

The Malls Manager and his employees have ordered that:

The Malls Manager has also threatened to issue a fine for each breach of a flyer handed out in contravention of these three special conditions.

 

Is Brisbane City Council in agreement with these three special conditions above?

 

Because the three extra conditions are not general or common conditions to be found anywhere in writing, these three special conditions do appear to be a targeted and discriminatory invention by Malls Management (Brisbane City Council). The question one might ask is; Why is Malls Management intent to disturb this particular flyer distribution? I could speculate that Malls Management (and Brisbane City Council) may disagree with the Biblical sexual ethics which I represent; that homosexual conduct is sinful. Whatever the real reason is for Malls Management to discriminate with special restrictions, with the likely intent to unofficially prohibit this particular flyer distribution, it would be more honest if Malls Management (and Brisbane City Council) upfront declared its real reason. If Malls Management (and Brisbane City Council) opposes for example Biblical sexual ethics, then just say so. You might actually gain popular support, even as you subsequently oppose God.

Brisbane City Council,

 

Because it is very difficult to attain truthful communication with the adversarial City Council Malls Manager and the Malls Management employees, I will direct the communication to Brisbane City Council.

 

On Monday April 7, 2014, the Malls Manager Steven Ford and one of his employees approached me while I was standing constantly in one location within the permitted area for flyer (business card) distribution. During the card distribution I did not move one decimeter in any direction, I did not approach anyone, and I stood with both feet in exactly the same spot at all times. In spite of my fulfilment of all conditions of permit, the Malls Manager and his employees approached and threatened me that they will issue a fine, if I continue to hand out flyers in spite that I am abiding by the conditions of the permit. Neither the Malls Manager nor his bonehead employees provided any new reason for the Malls Management threat of fines if I were to hand out another flyer.

 

The Malls Manager and his (bonehead) employees have ordered me previously that:

 

1) I am not allowed to speak.

2) I must hold the flyer onto my chest beneath my face and wait silently.

3) I am not allowed to hand out any flyer unless someone walks up to me and asks “Can I have one of those flyers?”

 

These three thoughtless extra conditions are not written in the Brisbane City Council conditions which are common for all applicants. Therefore, these ludicrous extra conditions must have been invented by the Malls Manager Steven Ford and his employees.

 

I had invited Malls Manager Steven Ford to meet me on site to demonstrate these three extra conditions on Friday April 4, 2014, but the Malls Manager did not show up. He instead turned up on Monday April 7. When the Malls Manager approached me on Monday April 7, I suggested that he comes back on Tuesday April 8 so that I could voice record and photo document his ludicrous demonstration of his three extra conditions. He refused to return another day. Therefore, I informed the Malls Manager that anything the Malls Manager wants to communicate must instead be in writing. He refused to write an email. When I asked the Malls Manager what he wanted, he replied that he did not know. As a means to assure the Malls Manager and his employees that I will not tolerate their dishonesty, corruption and thoughtlessness, I therefore vocally interfered with any attempt from the Malls Manager to make any further statements without a record of his statements.

 

I hereby request from Brisbane City Council to inform if the three extra conditions set by the Malls Manager Steven Ford are in compliance with the general conditions and intentions of Brisbane City Council.

 

Is Brisbane City Council in agreement with the three extra conditions above?

If we are able to find an agreement that both parts are comfortable with, then that would of course be great.

 

Due to the adversarial interaction with the two Malls Management employees on Wednesday April 2, which did erode a normal level of trust and respect, I shall voice record the conversation with you when we meet. Likewise, any future interactions with Malls Management employees I will record.

 

The map which Malls Management provided in the pdf permit clearly shows that the area where I was standing was within the boundaries of the permitted area. If it is not a permitted area, the you should specify this under the genreal conditions. And the ludicrous statements made by your two employees as to no flyer distribution being allowed unless members of the public approaches and specifically asks "Can I have one of those flyers?" indicates a deficiency of good common sense to the degree of intent to obstruct unfairly. The ethical principle in regards to democracy must apply: equal opportunity and equal restriction to all people regarless of the message. Any restrictions that are not common for everyone in writing, I shall ignore. I will not tolerate anti-Christian bias from any government body.

City Malls Management officers have advised me that they observed you standing in the walkway area between the garden bed and Queens Plaza in the vicinity of the brail trail and were directly approaching persons in the mall to hand out your flyers. They advised you about the requirements for conducting the peaceful assembly on the mall. This included information on the specific location, being adjacent to the garden bed in order to keep the brail trail clear and the need to observe condition 8 of the permit, “the participants in the peaceful assembly shall not during the course of the peaceful assembly directly approach mall patrons”. Additionally Mr Josh Dargusch provided further clarification in the email below that you are permitted to stand in the location and hand out flyers to those that approach you.

 

The permit letter issued to you states that City Malls Liaison Officers are likely to be in attendance during the assembly to ensure compliance with the permit conditions as these officers are authorised persons appointed by Brisbane City Council under the City of Brisbane Act 2010 and other local government related laws.

 

I will be more than happy to meet with you onsite to clarify and address any concerns you have with the assesmbly area or the conditions of the permit or I can be contacted on 3403 8366 to discuss the matter.

I hereby object to the obstructive manner and senseless imposition of interpretations by two collaborative employees of Brisbane Malls Managemant.

 

Firstly, it was obvious that Malls Management procrastinated administration of issuance of a permit. I had contacted Malls Management inquiring for a permit on March 13, 2014 and 18 days later a permit was finally sent.

 

Secondly, on April 2, 2014, two Malls Management employees approached me where I was standing within the permitted area and incorrectly claimed that I was not standing within the boundaries of the specified area on the permit. Even when I showed the map to the Mall Management employees with the map evidence, they still insisted that I was standing outside the designated are. This is a false claim.

 

Further, the two Malls Management employees demanded that I must not offer to anyone any leaflets with an outstretched hand, but that I must silently stand holding the flyer over my chest beneath my face (in a typical Jehovah Witnesses sect style), and that I may only hand out a flyer if someone from the public walks up to me and explicitly asks me “Can I have one of those flyers?”

 

It seems that these two Malls Management employees are abusing their authorities by imposing their personal interpretations of the conditions of permit.

 

If the Brisbane City Council in writing makes the same demands as these Malls Management employees (to falsely claim that the area where I was standing was outside the permit, and to ludicrously demand that I must hold the flyer on my chest beneath my face as a Jehovah Witness would hold their non-Christian magazine ‘Watchtower’ , and to demand that I must only give a flyer if someone specifically requests from me to have a flyer, and that I must not speak) , then I will certainly abstain from using Queen Street Mall to promote Christianity under such senseless and ludicrous conditions.

 

Malls Management employees should not exercise authority with their personal interpretations of conditions as a means to obstruct a message which they may not like.

         City Malls Management can only issue a permit for a period of one month.          The designated area to hold a peaceful assembly in the Brunswick Street Mall is not available for safety reasons due to the Brunswick Street Mall refurbishment. Reddacliff Place is available, however there are days that the designated peaceful assembly area has already been booked out in the month of April.

At present, there is no Brisbane City Council regulation that deals with the distribution of handbills. This means handbills and promotional leaflets can be distributed in public places, land or other property owned or under the control of Council, with the following exceptions:

•      Reddacliff Place

•      King George Square

Brochures and flyers are not allowed to be distributed in the malls due to increased litter problems and complaints of harassment from the public. As outlined under the Peaceful Assembly Act, leaflets and literature may be distributed only as long as they are not of a commercial nature.

I have been informed that a permit is required to distribute flyers to members of the public within the Queen Street Mall area. ASAP, please provide all relevant information related to the conditions for attaining a permit to utilise the public space at Queen Street Mall, and please provide the exact boundaries of the permit-required areas in Central Brisbane.

 

I intend to respectfully offer written information about the Biblically described person Jesus Christ to pedestrians on sidewalks in central Brisbane.

 

I will use no infrastructure, and no PA system, and no shouting. I will basically stand in one location at a time, respectfully handing out flyers (cards) to people that pass by along the location of choice. In personal conversations with members of the public I will answer questions about Biblical Christianity which individuals may ask, and I will pray together with those individuals who request from me that I pray with them.

 

I accept full responsibility to thoroughly ensure that carelessly discarded flyers will not litter public grounds with permanence, by personally picking up any improperly discarded flyer within a two-blocks zone of a distribution location, at the conclusion of the distribution time slot (or at least every second hour).

There will be only one person distributing these flyers (cards), but if another Christian wants to join, then there will be a maximum of two persons per location.

 

Are there zoned areas in Brisbane with restrictions for distribution of information about Christianity?

 

If a permit is required for information distribution in general, or if a permit is required for any specific zone, then please inform me.
